Marle Cordeiro Responds To Mike Postle’s Motion To Dismiss

On Monday June 29, 2020 Marle Cordeiro filed an “Opposition” to Mike Postle’s “Motion To Dismiss” in the complaint she filed against the poker pro in Nevada. As reported on rounderlife.com, Postle’s attorney Joseph N. Mott argued the case should be dismissed “for lack of personal jurisdiction, or, in the alternative, based on forum non conveniens.”

Mott clarified Postle is a resident of California, has limited contacts with Nevada, and all the evidence and most of the witnesses pertaining to the case are in California.

In Cordeiro’s response her attorney Maurice “Mac” VerStandig claims, among other things, Postle lured “professional poker players from throughout Nevada to come lose their money to him (in California) and be swindled by him.”

The complaint alleged Postle gained access to the hole cards on a livestream poker show at Stones Gambling Hall in Citrus Heights, California.

Explaining why Nevada is the proper forum, VerStandig asserts at least “part of the fraud” took place in Nevada, because Cordeiro watched the show from her home state.

The poker show was aired on both YouTube and Twitch streaming platforms.

“A significant part of the fraud at issue herein was perpetrated upon Ms. Cordeiro in the State of Nevada, as it is there that she consumed broadcasts of the fraudulent play of the Defendant and the fraudulent representations of the at-issue poker game being honest.”

Stones Gambling Hall, which produced and marketed the Stones Live Poker Show, was not named as a Defendant in Cordeiro’s suit. Cordeiro’s response doesn’t clarify why she believes Postle was responsible for her viewing the show or specifically how he “duped” her into playing in it, since he had no part in its production or her decision to participate.

“Believing these poker games to be fair and honest, and falling for the Defendant’s dupe, Ms. Cordeiro traveled from her home in Nevada to California to partake in one such game with the Defendant.”

Responding to Defendant’s suggestion that Cordeiro elected to bring her own suit in Nevada because she was “drawing dead” in California, VerStandig clarified his client (Cordeiro) was never part of the California lawsuit –  “All parties acknowledge the Defendant was previously sued by numerous individuals – of which Ms. Cordeiro is not, and never has been, one – in the Eastern District of California.”

Her January 14, 2020 announcement on “The Rake” that she had joined the California lawsuit contradicts the statement, or at the very least reveals there was a change of plans at some point.
